Terms of use
The rules for using Cucha: what you can expect from us and what we expect from you.
1. Who we are and what Cucha is for
Cucha is a service that helps shelters, foster homes and adopters manage pets, adoptions and fostering. Cucha is not a shelter and is not a party to adoption or foster agreements: those are arranged directly between the shelter and each person.
2. Acceptance
By creating an account or using Cucha you accept these Terms, the Privacy policy and the Legal notice. If you do not agree, do not use the service.
3. Access and account
For now, access is by invitation only. You are responsible for keeping your details accurate, your credentials safe and for any use of your account. You can sign in with email and password or with Google, Apple or Facebook; in that case that provider's terms also apply.
4. Shelters
Each shelter is responsible for the accuracy of its animal profiles, for complying with the animal welfare rules that apply to it and for lawfully processing the data of the people it manages (adopters, foster homes, volunteers and team). Whoever registers a shelter confirms they are authorised to act on its behalf and is responsible for the access they grant to their team.
5. Adopters and foster homes
The information you send in an application must be truthful. The shelter decides on each application and Cucha does not guarantee any outcome. Some adoptions have legal requirements, such as the licence for potentially dangerous animals.
6. Content you publish
You keep ownership of what you upload (photos, text, documents) and confirm you have the right to publish it. You grant us a non-exclusive licence, limited to what is needed to host it, display it and provide the service, which ends when you delete it or close your account, except for temporary backups.
7. Publishing on Facebook
If a shelter connects its Facebook Page, Cucha only publishes the profiles the shelter chooses. The shelter is responsible for what it publishes, must comply with Meta's terms and can disconnect the Page at any time.
8. Prohibited uses
You may not: publish illegal, misleading or offensive content, or content showing animal abuse; use Cucha for commercial breeding or selling of animals; impersonate other people or organisations; or try to access other people's data or interfere with the service.
9. Availability and changes to the service
We work to keep Cucha running continuously, but there may be interruptions due to maintenance, faults or causes beyond our control. If we significantly change or remove a feature, we will give reasonable notice.
10. Intellectual property
The software, design, brand and logos of Cucha belong to its owner. Using the service gives you no rights beyond those needed to use it.
11. Third-party links and services
Cucha may link to or connect with third-party services (for example, Facebook or Google). We are not responsible for their availability or content.
12. Liability
Cucha is provided as is. We are not responsible for information published by shelters or users, or for the relationships between them (adoptions, fostering or donations). To the extent permitted by law, we are not liable for indirect damages. Nothing in these Terms limits your rights as a consumer.
13. Suspension and closing your account
We may suspend or close accounts that breach these Terms, in cases of fraud or where the law requires it. You can close your account at any time in Settings or by writing to legal@cucha.org.
14. Service continuity and closure
If Cucha stops operating, we will give at least 60 days' notice, by email and in the app. During that period you can download all your data from the Export centre in open formats. After that period, we will delete anything we are not legally required to keep.
15. Changes to these Terms
We may update these Terms. We will let you know about significant changes; if you keep using Cucha afterwards, you accept them.
16. Governing law and contact
These Terms are governed by Spanish law. If you are a consumer, you can bring a claim before the courts of your place of residence. For any questions, write to legal@cucha.org.
